Terms of Service

These Terms of Service apply to the use of the Senal platform, including the mobile app, web version and all related services ("Platform"). By using the Platform you agree to these terms.

Article 1 — Definitions

• Senal — The provider of the Platform, established in the Netherlands (senal.nl).
• Wholesaler — The business customer who uses the Platform for their own customers.
• Buyer / User — The employee or customer of the Wholesaler who places orders via the Platform.
• Order — A collection of products with quantities sent to the Wholesaler via the Platform.
• WhatsApp — The communication channel through which the Order is forwarded to the Wholesaler.

Article 2 — Services

Senal provides a digital B2B ordering platform enabling Users to:

• search products by barcode or text;
• add products to a cart in units of piece, box, crate or pallet;
• send orders to the Wholesaler via WhatsApp;
• view order history.

The Platform does not process payments. An Order is a statement of intent. Commercial fulfilment takes place between the Wholesaler and the Buyer.

Article 3 — Access and Account

Access to the Platform requires registration with a valid phone number. The User:

• is responsible for the accuracy of the provided information;
• may not transfer their account to third parties;
• shall use the Platform exclusively for commercial (B2B) purposes;
• is responsible for the security of their device and credentials.

Article 4 — Orders and Wholesaler Responsibility

Senal acts solely as a technical intermediary. Senal is not a party to the agreement between the Wholesaler and the Buyer and is not responsible for:

• the accuracy of product information, prices or stock levels;
• delivery, quality or availability of products;
• cancellations, returns or complaints about orders.

The Wholesaler is solely responsible for the accuracy of their product catalogue.

Article 5 — Personal Data (GDPR)

Senal processes personal data in accordance with the General Data Protection Regulation (GDPR). Processing includes:

• Phone number — for authentication and order processing.
• Order data — products, quantities and notes.
• Device token — for push notifications (optional).

Data is stored on secure servers within the EU (AWS Frankfurt). Order data is retained for a maximum of 2 years. You have the right to access, correct and delete your data. See our Privacy Policy for details.

Article 6 — Availability

Senal strives for maximum availability but does not guarantee uninterrupted operation. Maintenance, technical failures or updates may cause temporary limitations. Senal is not liable for damages resulting from unavailability.

Article 7 — Prohibited Use

It is not permitted to use the Platform for:

• placing fake or test orders without intent to purchase;
• automated order generation (bots, scrapers);
• infringing, fraudulent or unlawful activities;
• consumer purchases (the Platform is exclusively B2B).

Article 8 — Limitation of Liability

Senal's liability for direct or indirect damages is excluded except in the case of intent or gross negligence. In any event, liability is limited to the amount paid for the use of the Platform in the preceding 12 months.

Article 9 — Intellectual Property

All rights to the Platform, including software, design, texts and logos, vest in Senal or its licensors. Nothing in these terms grants the User a licence to these rights unless expressly stated.

Article 10 — Amendments

Senal reserves the right to amend these terms. Amendments will be announced at least 14 days before the effective date via the Platform or by email. Continued use after the effective date constitutes acceptance.

Article 11 — Governing Law and Jurisdiction

These terms are governed exclusively by Dutch law. Disputes will be submitted exclusively to the competent court in the district of Amsterdam, unless mandatory legislation provides otherwise.
